SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

Treatment and/or Disposal of Residual Waste.
The expected quantity of residual municipal solid waste from the
authorities is estimated to be about 300 000 tonnes per annum for
treatment and about 25 000 tonnes per annum for disposal.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: This proposed contract is for the
management, treatment and/or disposal of residual waste arising in
Staffordshire, Walsall, Sandwell, Warwickshire (and possibly within the
administrative area of other neighbouring and/or proximal waste disposal
authorities) to divert that waste from landfill.
The reference project comprises the design, construction, financing and
operation of a 300,000 tonnes per annum Energy from Waste (EfW) facility
at a site at Four Ashes on which a planning application has recently been
submitted by Staffordshire County Council (SCC). Participants in the
procurement process will be free to propose alternative sites and SCC
reserves the right to accept a departure from the reference project should
it need or choose to do so.
The successful contractor is expected to be responsible for the design,
building, financing, operation and maintenance of any treatment facility
(or facilities) and the diversion of residual waste from landfill to meet
the objectives of Staffordshire County Council's Joint Municipal Waste
Management Strategy (JMWMS) and to support the Partner Authorities in
diverting biodegradable municipal waste (BMW) from landfill.
The successful contractor will also be responsible for disposing of
treatment residues, marketing of recyclables and energy, and disposing of
some of the residual waste not subject to treatment, as appropriate.
The contract duration will be between 25 years from contract award and 30
years following the end of the construction period. The exact contract
length will be determined through the current procurement process. It is
also anticipated that the contract will include a provision to extend the
contract period by approx. 5 years (subject to section II.3).
It is currently envisaged that transfer facilities will be procured
through separate but coordinated contracts.
Estimated value of the project is 25 million per annum subject to
indexation.

Description of these options: It is anticipated that the contract will
include a provision to extend the contract period by approx. 5 years
(subject to section II.3).

months: up to 480 months including any extension period (see II.2.1) (from
the award of the contract).

Provisional PFI credits have been secured for the project from the
Department of the Environment, Food and Rural Affairs (DEFRA). It is
therefore anticipated that a final business case for the project will need
to be approved by DEFRA prior to contract award.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This authority will incorporate a minimum ten (10)
calendar day standstill period at the point when information on the award
of the contract is communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the contracting
authority before the contract is entered into. Applicants have two (2)
working days from the notification of the award decision to request
additional debriefing. Such information has to be provided a minimum of
three (3) working days before the expiry of the standstill period. Such
additional information should be requested from (please refer to the named
person in the address in part 1.1).
If an appeal regarding the award of a contract is not successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within three
(3) months). Where a contract has not been entered into the Court may
order the setting aside of the award decision or order the authority to
amend any document and may award damages. If the contract has been entered
into the Court may only award damages. The purpose of the standstill
period referred to above is to allow parties to apply to the Courts to set
aside the award decision before the contract is entered into.
