This Invitation for Tenders follows the General Procurement Notice for
this project which was published in Procurement Opportunities, on
27.5.2008 and updated on 20.6.2008.
The City of Batumi, hereinafter referred to as the Purchaser, intends
using part of the proceeds of a loan from the European Bank for
Reconstruction and Development (the Bank) towards the cost of the
procurement of (i) up to 100 mid-sized buses including spare-parts; and
(ii) maintenance tools and equipment for the improvement of Bus Depot
maintenance capabilities.
The Purchaser now invites sealed tenders from suppliers for the supply of
the buses and spare parts, plus needed maintenance tools and equipment to
be funded from part of the proceeds of the loan.
Tendering for contracts to be financed with the proceeds of a loan from
the Bank is open to firms from any country. This tender consists of 2
discrete lots: Lot 1 - Buses and spare parts; and Lot 2 - Bus maintenance
tools and equipment. Tenderers are encouraged to bid for both Lots. To be
qualified for the award of a contract for Lot 1 - buses and spare parts,
tenderers must satisfy the minimum criteria (applicable only to Lot 1)
that are listed in continuation:
(a) in the case of a tenderer offering to supply goods under the Contract
which the tenderer does not manufacture or otherwise produce, the tenderer
has been duly authorised by the manufacturer or producer of the goods to
supply the goods in the Purchaser's country (in the format indicated in
Volume I.vi.);
(b) the tenderer and the manufacturer of the goods have the financial,
technical and production capability and capacity necessary to perform the
Contract demonstrated by: total, cumulative revenues from the sales of
buses in the last three years of not less than EUR 50 000 000; and with
not less than EUR 15 000 000 of these total revenues from the sales of
buses in the last year of the above indicated three year period.
(c) The tenderer and the manufacturer shall demonstrate that they have
access to, or have available, liquid assets unencumbered real assets,
lines of credit and other financial means, sufficient to meet the cash
flow for a period of 6 months estimated as not less than EUR 15 000 000
taking into account the tenderer's commitments to other contracts.
(d) The manufacturer or supplier of the buses has or shall put in place
prior to delivery of the first bus a warranty support and post-warranty
service facility.
Alternatively, the manufacturer or supplier of the buses will arrange
(prior to delivery of the first buses) a legally binding contract with a
third-party maintenance provider to provide warranty and post-warranty
services. Any such third-party service provider's capability and
suitability to perform the needed maintenance services shall be subject to
prior verification and approval by the Purchaser.
As a further alternative, and at the Purchaser's discretion, the
requirements of paragraph (d) shall be satisfied if the manufacturer or
supplier of the Buses prior to delivery of the first bus enters into a
formal agreement with the Purchaser to provide on-call warranty technical
support by the Manufacturer's technicians both within the Purchaser's
operating depot and by offsite support as required. This alternative shall
require that the manufacturer or supplier of the buses provides an
effective training and preparation of the Purchaser's technicians and
maintenance facilities to enable the Purchaser's own workshops to provide
adequate routine maintenance and repair of the Buses as specified in the
Manufacturer's Service, Repair, and Maintenance Manuals. As part of this
option for satisfying the warranty support requirements the supplier or
manufacturer of the buses shall of necessity include in its bid the supply
of the needed maintenance tools and equipment as indicated in Volume
lll.ii Annex 5.
(e) The tenderer or the manufacturer of the goods has satisfactorily
delivered at least 150 new buses of all models in the last three years of
which the manufacturer has produced at least 75 new urban buses similar to
the offered model in the tender together with the appropriate contract
references. Similar in this context means that the reference buses should
have proven operation under the same type of urban usage as well as being
compliant with all the major technical specifications, referenced in
Volume II – Purchaser's Requirements of this document to the models
specified in the forthcoming tender.
(f) The manufacturing plant to be used for the manufacture of the buses in
question – in the event of contract award – must have been used for the
manufacture of buses for 36 months and during the last 12 months shall
have been used for the manufacture of the same or similar type of buses
prior to the date of the tender release. The plant must be certified for
quality assurance (ISO 9000 or similar).

All tenders must be accompanied by a tender security of EUR 100 000 or its
equivalent in a convertible currency.

Tenders must be delivered to the office at the address below on or before
