tender may be cancelled in case inadequate funds are available under the
financing agreement.
5. Contracting authority: The National Authorising Officer for the EDF in
Ghana, Ministry of Finance and Economic Planning.
Contract specifications
6. Description of the contract: The subject of the contract is the
supply, delivery, installation, testing and commissioning by the
contractor of the following goods:
approximately 26,5 km of medium voltage and 21,7 km of low voltage
overhead lines, complete with wooden poles and accessories, and
approximately 71 transformers of capacity 25, 50 and 100 kVA, with 33
kV/415 V and 11 kV/415 V voltage ratios, in 1 lot, to be supplied (DDP
(delivered, duty paid)), installed and commissioned at various locations
in the 39 towns of the EDF-financed 'Small towns water supply and
sanitation project' in the central and western regions of Ghana within the
contract performance period of 12 months.
7. Number and titles of lots: The supplies and associated installation
works shall be provided in 1 lot.
Terms of participation
8. Eligibility and rules of origin: Participation is open on equal terms
to all natural and legal persons, participating either individually or in
a grouping (consortium) of tenderers, of the Member States and the
countries and territories of the regions covered and/or authorised by the
Regulation or other specific instruments applicable to the programme under
which the contract is financed (see also item 21 below). All goods
supplied under this contract must originate in these countries.
9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
Practical Guide to contract procedures financed by the 9th EDF.
10. Number of tenders: Tenderers (including firms within the same legal
group, other members of the same consortium, and subcontractors) may
submit only 1 tender. Tenders for parts of a lot will not be considered.
Any tenderer may state in its tender that it would offer a discount in the
event that its tender is accepted for more than 1 lot. Tenderers may not
submit a tender for a variant solution in addition to their tender for the
supplies required in the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of EUR 25
000 when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
This guarantee will be called upon if the tenderer does not fulfil all
obligations stated in its tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of no more than 10 % of the amount of the
contract at the signing of the contract. This guarantee must be provided
no later than 30 days after the tenderer receives the contract signed by
the contracting authority. If the selected tenderer fails to provide such
a guarantee within this period, the contract will be void and a new
contract may be drawn up and sent to the tenderer which has submitted the
next best compliant tender.
13. Information meeting and/or site visit: A clarification meeting/site
visit shall be held on 3.9.2008 (10:00), provisional time, at the STWASAP
project office in Takoradi, or at 1 or more of the project sites, to
answer any questions on the tender dossier which have been forwarded in
writing or are raised at the meeting. Minutes will be taken during the
meeting and these will be communicated — together with any clarifications
in response to written requests which are not addressed during the meeting
— in writing to all the tenderers at the latest 11 calendar days before
the deadline for submission of tenders. No further clarification will be
provided after this date. All costs of attending this meeting must be met
by the tenderers.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of execution: The period of performance of the contract shall
be 12 months.
Selection and award criteria
16. Selection criteria: The tenderer will be judged on his previous
experience in successfully performing similar supply contracts with an
installation component, and the tenderer shall demonstrate at least 2
contracts of similar scope and value, preferably within the region, within
the last 5 years.
17. Award criteria: Price.
Tendering
18. How to obtain the tender dossier: The tender dossier is available

tender/index_en.htm. The tender dossier is also available for collection
from the contracting authority against a fee of GHS 50. Tenders must be
submitted using the standard tender form included in the tender dossier,
whose format and instructions must be strictly observed.
