Contract specifications
6. Description of the contract: Upgrading of selected roads to bitumen
standards.
7. Number and titles of lots: Lot 1: Meru–Marimba (D482), Marimba–Nkubu
(D476), Nkubu–Mitunguu (D475) 46 km.
Lot 2: Imenti–Kionyo (T52/E779), Kionyo–Chogoria (D474), Ndagene Loop
(T51) 40 km.
Tenderers may bid for 1 lot or both lots.
Terms of participation
8. Eligibility and rules of origin: Participation is open on equal terms
to all natural and legal persons (participating either individually or in
a grouping (consortium) of tenderers) of the Member States of the European
Union and the countries and territories of the regions covered and/or
authorised by the Regulation or other specific instruments applicable to
the programme under which the contract is financed (see also heading 21
below). All goods supplied under this contract must originate in these
countries.

9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
Practical guide to EC External Aid contract procedures (Jan 2001)
(http://ec.europa.eu/europeaid/work/procedures/implementation/
practical_guide/previous_versions/2001/documents/practical_guide_en.pdf).
10. Number of tenders: Tenderers (including firms within the same legal
group, other members of the same consortium, and sub-contractors) may
submit only 1 tender for 1 or more lots. Tenders for parts of a lot will
not be considered. Any tenderer may state in its tender that it would
offer a discount in the event that its tender is accepted for more than 1
lot. Tenderers may not submit a tender for a variant solution in addition
to their tender for the works required in the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee for an
amount of at least KES 20 000 000 or the equivalent amount in Euros
indicating lots separately when submitting their tender. This guarantee
will be released to unsuccessful tenderers once the tender procedure has
been completed and to the successful tenderer(s) upon signature of the
contract by all parties.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of no more than 10 % of the amount of the
contract at the signing of the contract. This guarantee must be provided
no later than 30 days after the tenderer receives the contract signed by
the contracting authority. If the selected tenderer fails to provide such
a guarantee within this period, the contract will be void and a new
contract may be drawn up and sent to the tenderer which has submitted the
second best admissible tender.
13. Information meeting and/or site visit: A mandatory pre-tender site
visit will be held on Thursday 25.9.2008 (9:00) starting at the District
Roads Engineer's office in Meru town. A mandatory information meeting will
be held on Friday 26.9.2008 (9:00) at the same venue.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of execution: The period of execution is 24 months with a 12
months maintenance period.
Thereafter, it is the intention of the contracting authority to proceed
within a future tender with the implementation of 5-year performance based
maintenance contracts.
Selection and award criteria
16. Selection criteria: 1. The following selection criteria will be
applied to candidates. In the case of applications submitted by a
consortium, these selection criteria will be applied to the consortium as
a whole.
Economic and financial standing of candidates (based on item 4 of the
application form):
(a) the average annual turnover of the candidate over the last 5 years
must exceed EUR 15 000 000; for an award of 2 lots, the average annual
turnover over the last 5 years must exceed EUR 30 000 000;
(b) the average of cash and cash equivalents at the beginning and end of
year are positive.
2. Must have completed at least 2 projects of the same
nature/amount/complexity as the works concerned by the tender over the
last 5 years.
3. All key personnel must have at least 10 years of appropriate experience
and proven qualifications relevant to the works of similar nature to this
project.
17. Award criteria: Price.
Tendering
18. How to obtain the tender dossier: The tender dossier is available
from: Room 415, 4th Floor Transcom House, Ngong Road PO Box 30260, 00100
Nairobi, Kenya,
upon payment of Kshs 10 000 or EUR equivalent which excludes courier
delivery. It is also available for inspection at the premises of the
contracting authority. Tenders must be submitted using the standard tender
form included in the tender dossier, whose format and instructions must be
strictly observed.

before the deadline for submission of tenders given in item 19. The
contracting authority must reply to all tenderers' questions at least 11
days before the deadline for submission of tenders.
19. Deadline for submission of tenders: 11.11.2008 (12:00), local time at
the address given above.
Any tender received after this deadline will not be considered.
20. Tender opening session: The tenders will be opened immediately after
the tender submission deadline, at the Northern Corridor Board Room in
Transcom House, Lower Ground Floor, or as will be advised. Tenderers or
their representatives may attend the opening session.
21. Legal basis: Lomé IV Convention.
Administration Agreement signed by Government of Kenya/EC/KfW for Central
Kenya Rural Roads Programme in Kenya on 20.12.2005 and its addendum dated
18.12.2007.
