Supplies contract notice

et le compte des pays bénéficiaires (Cameroun, Centrafrique, Congo, Gabon,
Guinée équatoriale, São Tomé e Príncipe et Tchad).
Contract specifications
6. Contract description: The contract is for the supply of computer
equipment, basic software and network equipment, and includes their
installation and the provision of an after-sales service, for:
(1) the interconnection of customs offices located along transport
corridors within the country;
(2) the interconnection between countries in the CEMAC zone;
(3) the interconnection between the CEMAC Commission, the interstate
customs school in Bangui and CEMAC countries.
7. Number and titles of lots: 8 lots.
Lot 1: supply and installation of equipment for the CEMAC and the
interstate customs school in Bangui.
Lot 2: supply and installation of equipment for the Asycuda national
centre of Cameroon and along the transport corridor.
Lot 3: supply and installation of equipment for the Asycuda national
centre of the Central African Republic and along the transport corridor.
Lot 4: supply and installation of equipment for the Asycuda national
centre of Chad.
Lot 5: supply and installation of equipment for the Asycuda national
centre of the Congo.
Lot 6: supply and installation of equipment for the Asycuda national
centre of Gabon.
Lot 7: supply and installation of equipment for the Asycuda national
centre of Equatorial Guinea.
Lot 8: supply and installation of equipment for the Asycuda national
centre of São Tomé and Príncipe.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open
on equal terms to natural persons and legal entities (irrespective of
whether they are taking part as individuals or as part of a grouping
(consortium) of tenderers) from the ACP countries and the Member States of
the European Union, and also to international organisations as authorised
by the instrument applicable to the programme under which the contract is
financed (see also point 22). All the goods supplied under this contract
must originate in 1 or more of these countries.
9. Grounds for exclusion: Tenderers must submit a declaration stating
that they are not in any of the situations listed in section 2.3.3 of the
Practical Guide to contract procedures in the context of external actions.
10. Number of tenders: Tenderers cannot submit more than 1 tender per
lot. Tenders for part of a lot will not be considered. Tenderers may state
in their tender whether they would grant a discount should they be awarded
several lots. Tenderers cannot submit a variant tender in addition to
their tender for the supplies required in the invitation to tender
dossier.
11. Tender guarantee: Tenderers must furnish a tender guarantee for:
lot 1: EUR 1 100;
lot 2: EUR 1 700;
lot 3: EUR 1 200;
lot 4: EUR 800;
lot 5: EUR 800;
lot 6: EUR 800;
lot 7: EUR 800;
lot 8: EUR 800,
when they submit their tenders. This will be returned to unsuccessful
tenderers once the invitation to tender procedure has been completed and
to the successful tenderer(s) once the contract has been signed by all
parties. This guarantee will be drawn on if the tenderer does not honour
all the obligations stipulated in the invitation to tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: There are no plans for a briefing.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Implementation period: The indicative implementation period runs as
from December 2008 for an estimated 4-month duration.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. Where tenders are submitted by a consortium, these criteria
will apply to the consortium as a whole.
(1) Tenderers' economic and financial capacity (based on point 3 of the
tender form for a supplies contract):
(a) tenderers' annual turnover for the past 3 years (2005–2007) must
exceed the financial proposal for the lot in question.
The consolidated annual turnover for the past 3 years for the consortium
taken as a whole must exceed the financial proposal for the lot in
question.
As proof thereof, tenderers and/or consortia must enclose with their
tender the documentation showing their financial situation, and in
particular, financial statements for the past 3 years which have been
certified by an approved business auditor.
(2) Tenderers' professional capacity (based on points 4 and 5 of the
tender form for a supplies contract):
(a) they must have at least 3 permanent staff working in the field of the
lots in question.
(3) Tenderers' technical capacity (based on points 5 and 6 of the tender
form for a supplies contract):
(a) tenderers must have successfully carried out 1 supplies contract
similar to the lots and of an equivalent or greater value in the past 3
years (August 2005 to August 2007).
The potential successful tenderer may be required to provide a copy of the
final acceptance certificate for these contracts at the time contract
award is announced;
(b) tenderers must furnish proof that they can provide, or will be able to
provide, appropriate after-sales services in the country covered by the
lot, either by being physically present in the country or by submitting a
collaboration agreement with a supplier capable of providing similar
after-sales services.
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. These
bodies must comply with the same eligibility rules, in particular
regarding nationality, as the economic operator in question.
17. Award criteria: Price.

It can also be obtained from the contracting authority. The standard
tender form for a supplies contract must be used to draw up tenders. This
form can be found in the invitation to tender dossier, and its clauses and
format must be strictly adhered to.

19. Final date for submission of tenders: 20.10.2008 (15:00).
Tenders received after this deadline will not be considered.
20. Tender opening session: Tenders will be opened on 21.10.2008 (10:00)
at the 'Commission de la CEMAC'.
21. Language for the procedure: French must be used for all
correspondence concerning this invitation to tender.
22. Legal basis: ACP-EC Partnership Agreement signed in Cotonou on
23.6.2000, as amended in 2005.
Decision No 2/2002 of the ACP-EC Council of Ministers published in OJ L
320 of 23.11.2002.
