SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:

II.1.5) Short description of the contract or purchase(s): Sandwell
Metropolitan Borough Council ("the Council") is seeking to procure an
integrated waste and cleansing services contract which includes waste
collection, transfer, reuse, recycling, composting, treatment and
disposal, together with cleansing and associated services. The Council may
also consider the inclusion of other environmental services. It is
anticipated that the contract will commence in mid-2010 and is likely to
be for a term of between 20 and 30 years. The length of the contract will
be subject to discussion during the Competitive Dialogue. The Council is
seeking to establish a public private partnership with either a single
private sector contractor or a consortium headed by a clearly defined lead
contractor. This could incorporate a joint venture arrangement for all or
part of the services. Current MSW arisings are approximately 140 000
tonnes per annum and it is anticipated that this figure could rise to 200
000 tonnes by 2030. The Council is seeking a best-value solution that may
involve using existing waste recycling, composting, treatment, transfer
and depot facilities or the construction of new facilities. The Council
intends to purchase and remediate a site in West Bromwich which would then
be made available to the contractor for development as an Eco-Park
(recycling, composting, treatment, transfer and depot facilities) if
required. Remediation of the site could be carried out by either the
Council or the successful contractor. The Council is willing to consider
the provision of facilities with a greater capacity than that required for
this contract to allow the acceptance of third party wastes where this is
beneficial to the Council. This may include working with the Council to
provide services to other local authorities in the West Midlands. The
Council have signed a Memorandum of Understanding and Agreement with
Staffordshire County Council for the treatment and disposal of between 50
000 and 60 000 tonnes per annum of residual waste at its proposed new
Energy from Waste Facility which is scheduled to open between 2013 and
2015. The Council may be interested in the successful contractor providing
some interim treatment and disposal capacity in the period from
commencement of this contract until the Staffordshire Energy Waste
Facility is available. The Council may also be interested in the
contractor providing treatment or disposal capacity for residual tonnages
in excess of the capacity available for the Council in the Staffordshire
Energy from Waste Facility. Bidders selected to participate in the
Competitive Dialogue will be invited to put forward their proposals during
the dialogue. In recognition of the fact that the procurement process will
take approximately two years to complete, the Council is currently
evaluating separately procuring interim waste disposal solutions which may
also provide waste disposal from the commencement of this contract until
the Staffordshire Energy from Waste Facility is available. The Contractor
may be required to manage these arrangements from the commencement date as
a nominated sub-contractor. The Council may consider purchasing any
electricity and/or biofuel produced by the Contractor.

Description of these options: There may be options to extend the term of
the contract to up to 30 years and these will be subject to discussion
during the Competitive Dialogue.

III.1) CONDITIONS RELATING TO THE CONTRACT

performance related payment mechanism. The Council may require performance
bonds, parent company guarantees, collateral warranties and/or other forms
of appropriate security to secure proper performance of the contract.

and payment arrangements will be detailed in the procurement
documentation.

whom the contract is to be awarded: The Council reserves the right to
require consortia to take a particular legal form or to require that one
party has primary liability or to require each party to be jointly and
severally liable.

Council intends to select up to six companies to participate in dialogue.
If more than six companies satisfy the Pass/Fail criteria within the PQQ,
then companies that submit PQQs that pass the Pass/Fail criteria will be
ranked in accordance with the following criteria and up to six companies
will be invited to participate in dialogue: Service Delivery and Technical
40 % Financial and Commercial 30 % Employment Issues 20 % Overall
Integrity and Integration 10 %.

VI.1) THIS IS A RECURRENT PROCUREMENT: No.

VI.3) ADDITIONAL INFORMATION: It is proposed that interested parties
attend a Bidders Open Day on 25.9.2008. An E-Box portal will be used
through the procurement process. For access to the portal or for
non-electronic copies of the PQQ and Memorandum of Information, please use
the contact address in I.1) or www.WIP.sandwell.gov.uk Please indicate in
your correspondence the name, address, contact telephone number and email
address of your lead officer. As a result you will receive an e-mail from
E-Box with instructions on enrolling in and accessing the E-Box site. That
will enable you to download all PQQ and Memorandum of Information
documents from the portal and upload your responses. During the PQQ
process there is no charge for this service to applicants. Companies
selected to participate in the Competitive Dialogue will subsequently
incur a charge of 20GBP per month per User payable to E-Box from the start
of the Invitation to Submit Detailed Solutions (ISDS) stage of the
dialogue. The E-Box system will be used as the portal for all contract
documents up to the award of contract. The PQQ and Memorandum of
Information are available upon request for download from E-Box from the
date of dispatch of this notice until 3.10.2008. Expressions of Interest
must be by way of completion and return of the PQQ by the date and in the
manner specified in the above documents. The Council reserves the right
not to award a Contract or to cancel this procurement at any stage. It is
envisaged that TUPE will apply to the Contract.
