III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Guarantees may be required
from banks and parent companies. Cover for professional indemnity,
employer liability and third party liability will also be required.

whom the contract is to be awarded: Joint and several liability.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: To assist
selection of tenderers, suppliers will be download a pre-qualification
questionnaire from the Scottish Parliament website (PQQ) for completion
and return. The PQQ must be completed and returned by 24.9.2008. The PQQ
consists of an explanation of the SPCB's requirements and a request for
information. The SPCB intends to determine a shortlist of candidates based
on the suppliers' responses to this OJEU advertisement and the PQQ.
Candidates will be asked to provide information in the PQQ on their
financial, business probity, service operation, quality and the
environment.
Further requests for information may be used to assist in this process.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: The following
information must be provided with the PQQ:
— Statements of overall turnover and turnover for the last 2 financial
years,
— Company registration number and address, VAT registration number,
details of parent company and other group companies where applicable.

evaluating if requirements are met: The following information must be
provided with the PQQ: the organisations will be required to demonstrate
their skills, experience, ability and technical capacity in the delivery
of similar goods and services.

VI.3) ADDITIONAL INFORMATION: The Scottish Parliamentary Corporate Body
does not commit to letting a contract(s) for all or any of the
requirements listed should it become evident that it is not economically
advantageous to do so.
The Scottish Parliamentary Corporate Body will not be liable for any costs
incurred by those expressing interest in or tendering for this contract.
Compliance with all relevant legislation is required during the tendering
process and the terms of any resulting contract.
Any contract awarded will be subject to the Law of Scotland.
As part of the SPCB responsibilities under the Freedom of Information
(Scotland) Act 2002, the SPCB may be required to disclose any information
provided by you in relation to this requirement, to anyone who makes a
request under the Act.

pre-qualification questionnaire (PQQ). The PQQ consists of an explanation
of the SPCB's requirement and a request for high level product
information.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Scottish Parliamentary Corporate Body will
incorporate a minimum 10 calendar day standstill period at the point at
which information on the award of the contract is communicated to
tenderers. This period allows unsuccessful tenderers to seek further
debriefing from the contracting authority before the contract is entered
into. Applicants have 2 working days from the notification of the award
decision to request additional debriefing and that information has to be
provided a minimum of 3 working days before the expiry of the standstill
period. Otherwise debrief information will be made available to you within
15 calendar days of the receipt of your request.
Such additional information should be requested from the name and contact
details provided at Section I.1. If an appeal regarding the award of
contract has not been successfully resolved, the Public Contracts
(Scotland) Regulations 2006 (SSI 2006 No.1) provide for aggrieved parties
to take action in the sheriff court or Court of Session. Any such action
must be brought promptly (generally within 3 months) (see regulation 47 of
the 2006 Regulations). Where a contract has not been entered into, the
court may order the setting aside of the award decision or order the
authority to amend any document and may award damages. If the contract has
been entered into, the court may only award damages.
