The National Research Council, Plant Biotechnology Institute in
Saskatoon Saskatchewan requires the supply of a NorgrenSystems
CP7200 colony picking robot. The only known supplier that can
meet their needs is:

An important project at the NRC-PBI is the sequencing of 400,000
cDNA clones from flax, lentil, chickpea and field pea as part of
one-year (2008/09) funded initiative. All the sequencing must be
complete by March 31st 2009. A key aspect of this work is the
picking of the individual cDNA colony clones into 384 well
glycerol plates for storage prior to sequencing and the
re-arraying of the clones for future applications. The volume of
this effort will require the purchase of a colony picker with
the following characteristics: 1) picking capability >5,000
colonies per hour; 2) pick from a variety of target plates and
into a variety of destination plates; 3) picking platform
capable of continuous and simultaneous picking, inoculation and
sterilization of colonies during picking and re-arraying
applications for minimal colony transfer time and maximal
throughput; 4) software GUI for operation and interface
capability with robotic plate handlers; 5) capable of
distinguishing small (<0.5mm) and blue from white colonies; 6)
small footprint, no bigger than 2 feet wide and 2 feet deep, to
fit on standard lab bench; and 7) warranty support in Canada.

SOLE SOURCE JUSTIFICATION:
The NorgrenSystems CP7200 is the only picker with above
combination of characteristics. It meets the above criteria in
the following way:

1) Capability of picking up to 7,200 colonies per hour.
2) Picks from round Petri dishes, 10 x 10cm square plates and
NUNC Omnitrays and into a range of 96 and 384 well destination
plates.
3) A unique circular picking head containing 20 picking pins
with stations for accessing source plates, accessing destination
plates, accessing wash bath and heat sterilization. The circular
picking head allows for continuous and simultaneous motion
during the picking and re-arraying eliminating dead time
associated with wash cycles.
4) A GUI is provided for setting imagining and picking
parameters. Interface software is included and is hardware
compliant so that 3rd party plate handlers can automatically
load and unload both source and destination plates. This feature
is critical so the picker can be upgraded for future more
automated applications especially when a significant amount of
plate handling is done.
5) The picker can distinguish blue from white colonies and
colonies as small as 0.3mm in size.
6) The CP7200 is 22" wide and 22" long.
7) The picker will be supplied with warranty on all parts and
labour in Canada.

(d) only one person is capable of performing the contract.

Agreement on Internal Trade Article 506:
12) Where only one supplier is able to meet the requirements of
a procurement, an entity may use
procurement procedures that are different from those described
in paragraphs 1 through 10 in the
following circumstances:
a. to ensure compatibility with existing products, to recognize
exclusive rights, such as
exclusive licences, copyright and patent rights, or to maintain
specialized products that must
be maintained by the manufacturer or its representative;
b. where there is an absence of competition for technical
reasons and the goods or services can
be supplied only by a particular supplier and no alternative or
substitute exists;

(b)where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists; (CAP Code 71)

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
