Contract specifications
6. Object of the contract: Unit price technical assistance contract.
7. Contract description: As part of the call for projects under the
'ACP/EC energy facility', the Republic of Chad submitted a project to the
European Commission involving drawing up a 'Strategic plan for improving
energy management and governance'.
This project involves providing the Ministry for mines and energy (MME)
with an expert (TA) for 1,5 years to build up its capacities, particularly
through:
— recruiting and monitoring a consultancy firm to be responsible for
drawing up the development plan for the energy sector in Chad (master
plan),
— providing the MME with the capacity to plan, schedule, implement,
monitor and assess institutional reforms and investment projects.
The aim of the technical assistance assignment is to run the project, in
collaboration with managerial staff at the MME, so that the strategic
guidelines are complied with, mainly by:
(a) reducing environmental degradation;
(b) producing or importing energy at a cost accessible to the poor
populations and which will encourage productive activities;
(c) devising a set of initiatives which will contribute to building the
economy and improving living conditions of the populations in Chad.
1 expert will be required for the technical assistance services, with at
least 15 years' professional experience in the field of energy strategy,
including 2 years in sub-Saharan Africa. Said expert will preferably be an
engineer-economist qualified in energy planning and institutional reform.
The technical assistance expert must read, write and speak French
fluently. Experience in the Central African region would be desirable.
8. Number and titles of lots: The contract comprises 1 lot only.
9. Maximum budget available: EUR 372 000.
10. Object of any additional services: Subject to the availability of
funding, the contracting authority may decide, at its own discretion, to
extend the term of the contract and/or its object up to a maximum amount
not exceeding the initial contract value and duration. Any contract
extension is subject to satisfactory performance by the contractor.
Conditions for participation
11. Eligibility: Participation in the contract is open to all legal
entities from the European Union Member States (those that indeed
contribute to the funds) and from the countries and territories of the
regions covered by the other instruments applicable to the programme under
which the contract is financed (see point 30). International organisations
may also take part. Participation of natural persons is governed by the
legal provision applicable to the programme under which the contract is
financed.
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All the
members of a consortium (i.e. lead company and all other members) shall be
jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, the application concerned will be automatically
disqualified (in particular, the application from the whole consortium
where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit 1 application irrespective of whether they take part as a sole
legal entity, or as a lead company or member of a consortium submitting an
application. Should a natural person or legal entity submit more than 1
application, all the applications involving said party will be
disqualified.
14. Prohibition on alliances between shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted procedure.
Candidates invited to tender may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: Candidates must sign and enclose with their
application the statement provided in the standard application form
confirming that they are not in any of the situations described in section
2.3.3 of the Practical Guide to contract procedures for EC external
actions.
16. Subcontracting: Subcontracting is not permitted.
17. Number of candidates invited to tender: A minimum of 4 and a maximum
of 8 candidates will be invited to submit detailed tenders for this
contract, depending on the applications received.
Provisional schedule for activities
18. Scheduled date for dispatch of invitations to tender: 28.10.2008.
19. Provisional start date for the contract: 2/2009.
20. Initial contract length, and possible extension: Expected duration of
approximately 18 months.
The contract may be extended at a later date, subject to the approval of
the awarding authority and the European Commission.
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. Where applications are submitted by a consortium, then the
criteria will apply to the consortium as a whole.
1) Candidates' economic and financial capacity:
(a) candidates (this applies to all the members of a consortium) must be
able to prove that they have been in business for at least 5 years. The
following documents must be submitted in support of the figures given in
the application form (consortia must provide these documents for all their
members):
— average balance sheet figures for the 3 years 2005–2006–2007 for which
accounts have been closed,
— statement as to overall turnover and turnover for contracts carried out
in the 3 financial years in question (2005–2006–2007),
(b) candidates' average annual turnover must be at least EUR 800 000,
(c) cash and cash equivalents at the beginning and end of the financial
year must be in surplus, overall.
2) Candidates' professional capacity:
candidates must show that they have the following permanent staff
(permanent employment contract) on the date of the application deadline:
— at least 3 experts with more than 10 years' experience in projects
involving energy planning and institutional reform of the energy sector.
'Short-term' contracts are not considered as permanent employment
contracts.
3) Candidates' technical capacity:
candidates must prove that they have extensive experience in the energy
strategy and energy planning sector, and in institutional reform of the
energy sector. The quality of applications will be assessed on the basis
of the following characteristics:
— a minimum of 3 projects, 2 of which were completed in the past 5 years
(2003–2008),
— at least 1 of the 3 projects must have been in sub-Saharan Africa and/or
an ACP country,
— at least 1 project involving methodology, technology-management and
capacity transfer to partners,
— project manager/main technical assistant located abroad for at least 24
months in total.
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. Such
bodies (e.g. economic operators' parent companies) must observe the same
eligibility rules, notably regarding nationality, as economic operators
themselves.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these candidates'
applications will need to be re-examined to determine which 8 applications
for the invitation to tender are the most suitable. Only the following
factors, listed in order of priority, will be considered in the
re-examination:
— selection criterion in point 2 — 'Candidates' professional capacity',
— selection criterion in point 3 — 'Candidates' technical capacity'.
It should be noted that preference will be given when comparing tenders
which are equally suitable economically and technically:
— to experts, institutions or consultancy firms from ACP countries,
— to tenders from individual ACP firms or ACP firms in a consortium with
European partners,
— to tenders submitted by European tenderers using subcontractors or
experts from ACP countries.
Should the successful contractor wish to subcontract work, preference must
be given to natural persons, companies and firms in the ACP countries that
are able to carry out the contract on the same terms and conditions.
22. Award criteria: Economically most advantageous tender.
The criteria are specified in the invitation to tender dossier appended to
the letter of invitation to tender which will be sent to shortlisted
candidates.

23. Final date for receipt of applications: 7.10.2008 (12:00), local time
in N'Djamena.
Applications received after this deadline will be rejected.
24. Application submission procedures and information to be supplied: The
standard application form must be used for applications. This form is
available from the following web address:

of this form must be strictly adhered to.
Additional documentation (brochure, letter, etc.) enclosed with the
application will not be considered.

The contract title, the contract notice number (see point 1) and the name
and address of the candidate must be clearly marked on the envelope
containing the application and must be quoted in all subsequent
correspondence with the contracting authority.
Applications submitted in any other way will not be considered.
26. Amendments to or withdrawal of tenders: Tenderers may amend or
withdraw their tender by giving notice thereof in writing before the final
date for submission of tenders. Tenders cannot be amended once this
deadline has passed.
Notice of amendments to or the withdrawal of a tender must be drawn up and
sent as per the instructions given in point 25. The word 'Modification'
(amendment) or 'Retrait' (withdrawal), as applicable, must be written on
the outside envelope.

tender procedure and contract must be in French.
