Project Ref: Irrigated Agriculture Project

1. The Millennium Challenge Corporation (“MCC”) and the Government of the the Republic of Armenia (the “Government” or “[GoA]”) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in the Republic of Armenia (the “Compact”) in the amount of approximately 236.5 million USD (“MCC Funding”). The Government, acting through Millennium Challenge Account-Armenia SNCO (the “Employer”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which this Invitation for Bids (“IFB”) is issued. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use of MCC funding and conditions to the disbursement of MCC funding. No party other than the Government and the Employer shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding.

2. The Compact program includes Irrigated Agriculture Project (IAP). The IAP provides for the physical, managerial and financial investment needs to generate sustainable increases in rural incomes through irrigated agriculture. These investments will be implemented through two critical activities: (i) the “Infrastructure Activity”; and (ii) the “Water-to-Market Activity.”

Under the Infrastructure Activity (IA), MCC funding will be used to increase the land area under irrigated production and improve the overall efficiency of sourcing and water delivery to member farmers. This will be done by:
(i) rehabilitating 6 Main Canals;
(ii) constructing 7 gravity irrigation schemes;
(iii) renovating and resizing 18 pumping stations;
(iv) renovating the drainage system in Ararat Valley; and
(v) rehabilitating tertiary canals in 52 WUAs utilizing a 15 percent beneficiary co-investment.

1. This Invitation for Proposals follows the General Procurement Notice that appeared in dgMarket on September 23, 2008 UNDB Online on September 23, 2008, the MCA Entity website www.mca.am on September 23, 2008, and local newspapers Hayastani Hanrapetutyun on September 24, 2008.

3. The Employer now invites sealed bids (“Bids”) from eligible and qualified entities or persons (“Bidders”) to provide the works referenced above (the “Works”). The works include Rehabilitation of 4.2 km section and structures and pilot projects of Arzni-Shamiram Main Canal. Rehabilitation of structures for remaining five main canals. More details on the requirements are provided in the Bill of Quantities, Specifications and Performance Requirements, and Drawings.

4. This IFB is open to all eligible and qualified Bidders who wish to respond to the relevant bidding documents (the “Bidding Documents”). Qualification requirements, as more fully described in Section III, include: a/ minimum average annual turnover of USD 4 million or equivalent, calculated as total certified payments received for contracts in progress or completed within last 5 years; b/ experience under contracts in role of contractor, subcontractor, or management contractor for at least the last 5 years prior to Bid submission deadline and with activity in at least 9 months each year; c/ participation as contractor, management contractor or subcontractor in at least 2 contracts within the last five years each with a value of at least 5 mln. USD or equivalent that have been completed and are similar to the proposed works, etc.


5. A contractor will be selected under a competitive bidding method, the evaluation procedure for which is described in the Bidding Documents, in accordance with the “MCC Program Procurement Guidelines” which are provided on the MCC website at www.mcc.gov. Bidders should note that MCC procurement procedures and guidelines are similar to the World Bank procurement procedures and guidelines, but there are significant differences. It is a Bidder’s responsibility to fully understand MCC program procurement procedures and guidelines.

6. The Bidding Documents include the following Sections:

Section I Instructions to Bidders (“ITB”)
This section provides information to help Bidders prepare their Bids; it also provides information on the submission, opening, and evaluation of Bids and on the award of the proposed contract.

Section II Bid Data Sheet (“BDS”)
This section includes provisions that are specific to the procurement and that supplement Section I, Instructions to Bidders.
Section III Evaluation and Qualification Criteria
This section specifies the qualifications required of the Bidder and the criteria to be used to evaluate the Bids.

Section IV Bid Forms
This section contains the forms which are to be completed by a Bidder and submitted as part of its Bid.
Section V Form of Agreement and General Conditions of Contract (“GCC”)
This section contains the form of the contract agreement and the standard terms and conditions of the proposed contract.

Section VI Form of Special Conditions of Contract (“SCC”) and Annex to Contract
This section contains the form of those clauses of the proposed contract that supplement the GCC. This Section also includes an Annex (Annex A: Additional Provisions) that forms part of the proposed contract and contains clauses required to be included in all contracts supported by MCC funding.
Section VII Security Forms
This section contains forms, some of which are used in the Bid and some of which, when and if completed, will form part of the proposed contract. Certain of these forms will only be completed by the successful Bidder if the contract is awarded.

Section VIII Bill of Quantities
This section contains an itemized listing of the quantities of the Works. Quantities given are estimated and provisional, based on the Specifications and Drawings, and are given to enable Bidders to prepare priced Bids.

Section IX Specifications and Performance Requirements
This section sets out a description of the scope of the Works and presents the required standards for materials, plant, supplies, and workmanship to be provided. This section also presents the environmental, health and safety requirements to be satisfied by the contractor in executing the Works.

Section X Drawings
This section contains construction drawings to allow Bidders to understand the type and complexity of the Works and to prepare Bids.

7. The Bidding Documents will be placed on the Employer’s website at www.mca.am from the date of issue and prospective Bidders interested in submitting a Bid should submit an e-mail, giving full contact details of the prospective Bidder, to Mr. Rudolf Petrosyan, MCA-Armenia Procurement Officer at: petrosyanr@mca.am and copied to Gohar Mousaelyan, MCA-Armenia Procurement Specialist at: mousaelyang@mca.am .

8. A pre-bid meeting will be held at the time and date if so specified in the BDS. If a pre-bid meeting is held, attendance is strongly advised for all prospective Bidders or their representatives but is not mandatory.

9. The deadline for submission of Bids is 16:00 (local time) on November 12, 2008. Bids must be delivered to the address below at or before the time specified above. Late bids will be rejected. Bidders should be aware that distance and customs formalities may require longer than expected delivery time.
