SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Galway City Water Conservation Phase 2.

II.1.5) Short description of the contract or purchase(s): Galway City
Council proposes to engage a Client Representative experienced in water
conservation and network management, to advance Galway City Water
Conservation Phase 2 throughout the city with a view to managing leakage
and minimising water losses. The appointment is for all stages from the
preparation of a Preliminary Report to preparation of Contract Documents,
Management of Tender Process, Tender Assessment & Recommendation,
Supervision of Construction and Commissioning of all Stage 3 Network
Rehabilitation Works. The appointment also includes works arising from the
recommendations of "The Galway City Water Conservation and Network
Management Project, Status Review Report" and in particular completion of
Stage 1 and Stage 2 works.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The Client Representative will be
required to prepare a Preliminary Report which sets out the economic and
environmental justification for the scheme as well as the costing and
time-scale of it.
The Galway City Water Conservation and Network Management Project, Status
Review Report is in effect the Preliminary Report for completion of Stages
1& 2 of Water Conservation. It needs to be reviewed and updated to
implement further Stage 3, Rehabilitation Works for Water Conservation. It
then will form the basis of the Preliminary Report for this appointment.
The Preliminary Report will also identify Stage 3, Rehabilitation
proposals including a Rehabilitation Strategy, which must be submitted to
the DEHLG before the Department will approve any new mains rehabilitation
project.
Upon approval the rehabilitation proposals can be divided into work
packages that can be submitted in sequence as they are developed and thus
allow early advancement of the works in the most critical DMA’S.
The appointment will include the detailed design, preparation of contract
documents, Management of Tender Process, Tender Assessment and
Recommendations, Supervision of Construction and Commissioning of the
Stage 3 Network Rehabilitation Works and any other works arising from the
recommendations of the Preliminary Report.
The Client Representative will be required to prepare Preliminary Health &
Safety Plans for the project and to act as Project Supervisor Design
Process on behalf of Galway City Council in accordance with The Safety,
Health and Welfare at Work (Construction) Regulations, 2006 [S.I. 504 OF
2006]. The Client Representative may also be required to act as Project
Supervisor Construction Stage for the Construction elements of the
project.
II.2.2) Options: No.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 82 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Required.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: As per the
Government Standard Conditions of Engagement for Construction Consultants.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Prior to award, a grouping, if
successful, must contract as a single entity having joint and several
liability.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
The Government Standard Conditions of Engagement for Construction
Consultants provide for termination of the contract by the client at any
time (during any stage, or between stages, even if the project is
continuing).
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: (1) All
candidates will be required to produce a certificate or declaration
demonstrating that they are not bankrupt or the subject of an
administration order, are not being wound-up, have not granted a trust
deed, are not the subject of a petition presented for sequestration of
their estate, have not had a receiver, manager or administrator appointed
and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or
declaration demonstrating that the candidate, their directors, or any
other person who has powers of representation, decision or control of the
candidate has not been convicted of conspiracy, corruption, bribery, or
money laundering. Failure to provide such a declaration will result in the
candidate being declared ineligible and they will not be selected to
participate in this procurement process.
(3) All candidates will be required to produce a certificate or
declaration demonstrating that they have not been convicted of a criminal
offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or
declaration demonstrating that they have not committed an act of grave
misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which
they are established, regarding registration on the professional or trade
register.
(6) Any candidate found to be guilty of serious misrepresentation in
providing any information required, may be declared ineligible and not
selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a
member of the relevant organisation, in the State where they are
established, when the law of that State prohibits the provision of the
services, described in this notice, by a person who is not so licensed or
who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or
declaration demonstrating that they have fulfilled obligations relating to
the payment of social security contributions under the law or of the
relevant State in which the candidate is established
(9) All candidates will be required to produce a certificate or
declaration demonstrating that they have fulfilled obligations relating to
the payment of taxes under the law or of the relevant State in which the
economic operator is established.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: (1) All candidates will
be required to provide a reference from their bank.
(2) All candidates will be required to provide evidence of relevant
professional risk indemnity insurance.
(3) All candidates will be required to provide a statement, covering the 3
previous financial years including the overall turnover of the candidate
and the turnover in respect of the activities which are of a similar type
to the subject matter of this notice.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: (1) A statement of the candidate's
average annual number of staff and managerial staff over the previous 3
years.
(2) A statement of the candidate's technical facilities; measures for
ensuring quality; and their study and research facilities;
(3) A statement of the tools, plant or technical equipment available to
the service provider or contractor for carrying out the contract
(4) Details of the educational and professional qualifications of their
managerial staff
(5) List of services of a similar nature over the past 5 years.
(6) A declaration of competence to act as Project Supervisor Design
Process is required.
Minimum level(s) of standards possibly required: Applicants shall have
design and construction supervision experience of.
(1) at least one Water Conservation & Network Management Project
encompassing preparation of Preliminary Report,detailed design, contract
documents, contract supervision of construction and commissioning of Stage
3-Network Rehabilitation Works.
(2) Minimum of one Preliminary Water Audit.
(3) Maximum of 3 suitable examples of similar size and scope as above.
(4) The number of services of similar nature to which maximum marks will
be awarded is 3.
III.3) CONDITIONS SPECIFIC TO SERVICES CONTRACTS

terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate or in the descriptive document.

SECTION VI: COMPLEMENTARY INFORMATION
VI.3) ADDITIONAL INFORMATION: An Information Memorandum and
Pre-qualification Questionnaire is attached to this Notice. A hard copy
may be obtained by contacting Ray Brennan at the address and contact
numbers listed in Annex A.
The applicant shall fill out the prequalification questionnaire using
either the English or Irish language.
Six copies of the submission, clearly marked "Galway City Water
Conservation Phase 2 - Expression of Interest for Client Representative",
should be submitted to the address indicated in this notice.
Shortlisted candidates will be issued with the Request for Tender,
including the Brief, and will be invited to submit detailed Tender
Proposals.
Shortlisted candidates who submit detailed Tender Proposals may be
required to attend an interview with the Selection Board.
The Contracting Authority will NOT be responsible for any costs, charges
or expenses associated with an application submission or attendance at
interview, incurred by applicants.
It is a condition for the award of this contract that the candidate
selected and all proposed sub-consultants must be able to produce a valid
up-to-date Tax Clearance Certificate or C2 Certificate. In the case of a
non-resident candidate, they should produce a statement from the Revenue
Commissioners that they have satisfied them as to their suitability on tax
grounds to be awarded the contract. The firm to whom the contract is
awarded, and all sub-consultants, shall continue to hold valid
certificates for the duration of the contract.
The firm to whom the contract is awarded must have Professional Indemnity
Insurance cover in place and maintained to the value of at least €6.35M
with a reputable insurance company. It is a condition of the award for
this contract that the firm selected must produce evidence of such cover
prior to the award of contract and shall maintain such cover in place for
a period not less than six years after completion of the scheme.
The Contracting Authority undertakes to use its best endeavours to hold
confidential any information provided in the proposal submitted, subject
to the Contracting Authority's obligation under Law, including the Freedom
of Information Act, 1997. If the applicant(s) considers that any of the
information submitted in the proposal should not be disclosed because of
its sensitivity then this should be stated, along with the reason(s) for
considering it sensitive. The Contracting Authority may then consult with
the applicant in considering any request received under the Freedom of
Information Act, 1997 before replying to such a request.
