SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Study, design
and/ or build and /or maintain capital works as part of planned programme
of work. This will include but not be limited to;
(1) water and waste water infrastructure (including but not limited to
sewerage systems, water mains systems, sea outfalls and tunnels) and,
(2) water and waste water non infrastructure (including but not limited to
service reservoirs, water towers, pumping stations, water treatment works,
wastewater treatment works and sludge treatment works).

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Provision of works under various
projects as part of Anglian Water's capital investment programme (AMP5 and
possibly beyond) on a non-exclusive basis. The proposed size of the AMP5
Programme is contained in the draft business scenarios for 2010-2015, as
part of the submission for OFWAT's periodic review of prices, announced by
Anglian Water Services on 11.8.2008. The details can be found at:
www.anglianwater.co.uk. It has to be stressed that the proposed AMP5
Programme is a draft only which is subject to material changes as a result
of the determination by OFWAT and will not be finalised until November
2009 as in accordance with OFWAT's timetable. Interested parties may wish
to note that the current capital investment programme (AMP4, being 2005 -
2010) includes capital investment in excess of 1 billion GBP. The proposal
to be sought is to provide Anglian Water with the most advantageous offer
for the delivery of part of its Capital Investment Programme. The works
called for will include some or all of the following elements:
appraisal/feasibility study, modelling, design, construction,
installation, inspection, testing, commissioning, handing over, plant
performance control, monitoring and optimisation, maintenance, equipment
supply and replacement, refurbishment, repair, major refurbishment,
shutdown, overhaul and reinstatement, demolition, dismantling and
decommissioning. Individual project packages over 5 000 000 GBP and/or
specialist work may be excluded at the discretion of Anglian Water
Services.
The lots will be either the water and wastewater infrastructure capital
works, or, water and wastewater non-infrastructure capital works, or both
the water and wastewater infrastructure and non-infrastructure capital
works.
Bidders may apply for any or all of the following lots; a) Design and
Studies, and/or b) Design and Construction, and/or c) Construction.
II.2.2) Options: Yes.
Description of these options: Optional extensions to the initial contract
duration resulting in a maximum of a 10 year contract to year 2020,
subject to reviews prior to any contract extension.
Number of possible renewals:1 to 5.
II.3) DURATION OF THE CONTRACT OR TIME LIMIT FOR COMPLETION: Starting:
1.4.2010. Completion: 31.3.2015.
INFORMATION ABOUT LOTS
1) SHORT DESCRIPTION: Bidders may apply for any or all of the following
lots; a) Design and Studies, and/or b) Design and Construction, and/or c)
Construction.
2) COMMON PROCUREMENT VOCABULARY (CPV): 45000000, 71800000, 71000000,
50800000, 71320000, 71322000, 71322200.
3) QUANTITY OR SCOPE: The lots will be either:(1) the water and
wastewater infrastructure capital works, or (2) water and wastewater
non-infrastructure capital works, or (3) both the water and wastewater
infrastructure and non-infrastructure capital works.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Yes see below section VI.3.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Project payment will
be made in accordance with agreed project progress with payment either in
arrears or on a cash neutral basis. Liquidated damages may be
incorporated. Performance bond or a Parent Company guarantee may be
required where deemed appropriate. Further details will be provided in the
tender documentation.
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: Partners will be expected to work
together within an Alliance and / or Joint Venture relationship. Details
of the required structure will be provided in the tender documentation. In
the case of an award to a bidder bidding as a consortium or joint venture,
joint and several liability will be required under English Law.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
All bidders must meet the following two requirements in addition to those
stipulated . 1. Acceptance of LDs subject to a ceiling of 5 % of the
contract value. 2. Acceptance of a total contract liability equal to 100 %
of the contract value. Bidders may be required to meet the following
additional requirement. In addition, bidders who are awarded aggregated
contract works anticipated to exceed 60 000 000 GBP (indexed) will be
required to provide a performance bond or other surety bond to a sum of
not less than 10 % of the contrated value, OR parent company guarantee
from parent company which has a credit rating of at least A by Standard &
Poors.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Capable of
delivering capital works programme or parts thereof made up of individual
projects typically ranging in value in between 50 000 GBP to 10 000 000
GBP.
III.2.2) Economic and financial capacity: All bidders must meet the
following requirements.
1. Provision of statement of audited business account and overall turnover
for the previous 3 financial years and relevant insolvency/compliance
representations,
2. Provision of evidence of professional indemnity insurance and/or such
other insurance as will be applicable to undertake the contract works.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: Bidders are required to demonstrate
that they have proven experience of partnering/alliancing in the water and
wastewater industry and a track record to indicate capabilities for one or
more of the following as appropriate to their application (please refer to
annex B) a. Design and Studies, and/or b. Design and Construction and / or
c. Construction of the relevant water and wastewater infrastructure and/or
non-infrastructure including but not be limited to sewers, mains, pumping
stations, service reservoirs, water and wastewater treatment works and
associated mechanical and electrical plant and equipment and within the
last five years. Bidders shall demonstrate that they are a member of and
have been assessed by Verify (via Achilles), as part of the selection
criteria in the RFI process. For more information please refer to
www.achilles.com. The results of the standard Achilles Verification
process will be required by the due date for the return of the RFI.

VI.3) ADDITIONAL INFORMATION: Applicants shall note that the current
arrangements that Anglian Water Services Lts has with its current AMP4
Delivery Partners includes an option for extension to the contract
duration resulting a maximum of a 10 (ten) year contract through to
31.3.2015 latest.
Applicants responding to this Notice must answer the following questions
and provide the required details in the pre-determined format and submit
them as part of their expression of interest. A template for responses
must be obtained by E Mailing "send template" to
Amp5capitaldelivery@anglianwater.co.uk. Upon receipt Anglian Water shall
forward the relevant documentation.

capable of undertaking for Anglian Water Services on an annual basis.

The returned response will be assessed. Short-listed applicants will be
invited to participate in one or more pre-qualification and selection
processes through completion of a Request for Information document and/or
face-to-face interviews. A select list of entities will follow as the
result of a comprehensive evaluation process. The selected entities will
then be invited to tender, leading to a further detailed assessment and
negotiation stage. Pre-determined scoring criteria will be utilised.
Applicants shall provide details of a single point of contact
includinge-mail address that will be used for further and future
communications. All communications from interested applicants, including
requests to participate and responses to the above questions, shall be by
electronic mail as detailed in section l.1. Any dates quoted in this
notice are for guidance only. Applicants should also be aware that the
Transfer of Undertakings (Protection of Employment) Regulations (TUPE) (or
its European equivalent) may apply from delivery of previous capital
programme.
