II.1.4) Short description of the contract or purchase(s): Falkirk Council
is currently replacing four Secondary Schools under a variant of Public
Private Partnership called a Non Profit Distributing Organisation model
(NPDO). The Secondary Schools concerned are Denny High School, Grangemouth
High School, Falkirk High School and St Mungo's RC High School. The
private sector consortium the Council has contracted with to deliver the
new schools is called Falkirk Schools Gateway Limited and comprises
Ogilvie Limited, Stewart milne Limited, FES Limited and Royal Bank of
Scotland (heirinafter called "Gateway"). The Council wishes to purchase
and have installed cashless catering systems in these new schools. The
systems will remove the need for cash transactions between consumers and
catering staff and will be centralised and will facilitate more effective
management reporting. There is a clear emphasis in the schools concerned
on healthy eating as part of the Hungry for Success Initiative. The
contract will consist of the initial provision and installation of the
system along with providing appropriate training and subsequent
maintenance of the system which will run for an initial period of five
years with an option to extend annually for upto a further 5 years.

Falkirk Council will incorporate a minimum of 10 calendar day standstill
period at the point of information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have 2 working days from the notification of
the award decision to request additional debriefing and that information
has to be provided a minimum of 3 working days before the expiry of the
standstill period. Such additional information should be required from the
address in point I.1) of the contract notice. If an appeal regarding the
award of contract has not been successfully resolved The Public Contracts
(Scotland) Regulations 2006 (SSI 2006 No 1) provide for aggrieved parties
who have been harmed or are at risk of harm by a breach of the rule to
take action in the Sheriff Court or Court of Session. Any such action must
be brought promptly (generally within 3 months). Where a contract has not
been entered into the Court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the Court may only award
damages.
