ADVANCE CONTRACT AWARD NOTICE

Requirement: For the supply, delivery, installation and on-site
training of a Real-Time Polymerase Chain Reaction (PCR) Thermal
Cycler System complete with accessories, software, installation,
training and warranty for the Department of Agriculture and
Agri-Food Canada (AAFC) located at Lethbridge, Alberta.

Sole Source Justification: This system provides all three of
the following: fast real-time PCR, conventional PCR and can be
used as a plate reader. It is also able to detect up to five
(5) gene targets when multiplexing, has the option to use an
internal passive reference to normalize data, and can complete
PCR at either fast (within 30 minutes) or standard (1.5-2 hours)
ramping rates. In addition, for quantitative PCR, there is no
other supplier of is type of instrument that is validated for a
minimum 10 ul. This equipment can also distinguish between 5000
and 10000 template copies with at least a 99.7% confidence
level. Temperature accuracy is equivalent to +/-0.25oC (35oC to
95oC). Once initial calibration for specific dyes has been
completed the system does not require recalibration when plate,
sealant or reaction volumes are adjusted. The system has the
software capability to analyze unlimited numbers of 96 well
plates across experiments with the ability to correct gene
expression results, analyze different multiplex assays in
different wells on a 96-well plate, view multiplex targets in a
single well without having to cross-reference filter sets, edit
plates after runs, including running plates with no previous set
up, and design primers and probes. Sensitivity, efficiency and
accuracy are critical to research work at Agriculture and
Agri-Food Canada.

Government Contracts Regulations (GCR) Exception
5.002 (D) (2002-12-13) - Only one supplier person or firm is
capable of performing the contract.

AIT Limited Tendering
In accordance with AIT Article 506, Section 12 (B), where only
one supplier is able to meet the requirements of a procurement,
an entity may use procurement procedures that are different from
those described in paragraphs 1 through 10 in the following
circumstances:

(b) where there is an absence of competition for technical
reasons and the goods or services can be supplied only by a
particular supplier and no alternative or substitute exists.

Article 1016: Limited Tendering Procedures

1. An entity may use limited tendering procedures in the
following circumstances and subject to the following conditions,
as applicable:

(a) where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no
reasonable alternative or substitute exists.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
