SECTION II: OBJECT OF THE CONTRACT

requirement to ensure that all the DAR vehicles have periodical
maintenance and servicing of seat belts to provide a safe, comfortable
environment for DAR passengers and to comply with current legislation.

II.2.1) Total quantity or scope: The total quantity or scope is to
provide a service for up to 5 years.

Description of these options: The Authority may in its absolute discretion
extend the initial 3 year period of the contract by a period or a number
of periods not exceeding 2 years.

require that any Contract(s) awarded will be entered into by a single
entity on behalf of the successful candidate(s).

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements

— This will move the PQQ /ITT into your "My PQQs/ My ITTs" page. (This is
a secure area reserved for your projects only),
— You can now access any attachments by clicking the "Settings and Buyer
Attachments" in the "Actions" box 3. Responding to the tender,
— You can now choose to "Reply" or "Reject" (please give a reason if
rejecting),
— You can now use the ‘Messages’ function to communicate with the buyer
and seek any clarification,
— Note the deadline for completion, then follow the onscreen instructions
to complete the PQQ/ ITT,
— There may be a mixture of online & offline actions for you to perform
(there is detailed online help available) You must then publish your reply
using the publish button in the "Actions" box on the left-hand side of the
page.

IV.2.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated below:
1. Technical merit, organisational capability & resource, previous
experience, Health and Safety, environmental and ability to programme
timescales. Weighting: 45-55.
2. Cost. Weighting: 35-45.
3. Acceptance of LBSL Terms and Conditions. Weighting: 5-10.

TfL reserve the right to utilise an electronic auction as a means of

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: Yes.

VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The procurement process is being conducted
on behalf of Transport for London (TfL). TfL is a complex organisation
operating both as a Functional Body of the Greater London Authority (GLA)
under the direction of the Mayor of London and as a provider of transport
services. The services supplies or works may be provided to TfL and/or its
subsidiaries and/or the GLA or any other authority that is subject to the
requirements of either EU directive 2004/17/EC or 2004/18/EC. Any part of
TfL and/or any of its subsidiaries may award Contract(s) The Awarding
Authority reserves the right to withdraw from the procurement process and
may award a contract(s) in whole, in part, or not at all as a result of
the competition called for by this notice and the Awarding Authority shall
not be liable for any costs or expenses incurred by any candidates in
considering and/or responding to the procurement process All discussions
and meetings will be conducted in English Tenders and supporting documents
must be priced in sterling and all payments made under the contract will
be in sterling. LBSL and/or tfL and/or any subsidiary of TfL or the GLA
may interview any or all companies who express an interest for tendering
for this work. If and when this requirement is offered to tender, it may
be done in whole or in part via electronic means using the Internet, and
may also be through the medium of an electronic reverse auction. TfL is
acting as a central purchasing body on behalf of itself, all members of
the TfL group of companies and the Greater London Authority and its other
functional bodies (currently London Development Agency, the Metropolitan
Police, the London Fire and Emergency Planning Authority). Any of these
bodies that identify a need for similar services may award a contract to
the successful bidder substantially on the terms of the contract awarded
by TfL (if any).
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Authority will incorporate a minimum 10 calender day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have two working days from notification of the
award decision to request additional debriefing and that information has
to be provided before expiry of the standstill period. Such additional
information should be requested from the name and address Annex A. If an
appeal regarding the award of a contract has not been successfully
resolved the Public Procurement Regulations provide for aggrieved parties
who have been harmed or are at risk by harm by a breach of the rules to
take action in the High Court (England, Wales and Northern Ireland). Any
such action must be brought promptly (generally within 3 months). Where a
contract has not be entered into the court may order the settling aside of
the award decision or order the Authority to amend any document and may
award damages. If the contract has been entered into the court may only
award damages.
