TITLE: Bioaccessibility of polyaromatic hydrocarbon mixtures in incidentally ingested brownfield soils

1. The purpose and explanation of an ACAN

An Advance Contract Award Notice (ACAN) allows Health Canada contracting authorities to post a notice on MERX, for no less than fifteen (15) calendar days, indicating to the supplier community that a good, service or construction contract will be awarded to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.

2. Rights of suppliers

Suppliers who believe that they are fully qualified and available to provide the services or goods described in this ACAN may submit a Statement of Capabilities clearly demonstrating how they meet the advertised requirement. This Statement of Capabilities must be provided via e-mail only to the contact person identified in Section 12 of the Notice on or before the closing date and time of the Notice. If there is a reasonable level of evidence regarding capability, the requirements will be opened to electronic or traditional bidding processes.

4. Definition of Requirements or Expected Results

In June 2003, Treasury Board approved funding for a Federal Contaminated Sites Action Fund (FCSAP). That program is designed to ensure that federal departments identify, assess, manage and/or remediate federal contaminated sites under their custodianship. Under the FCSAP, Health Canada is designated, along with Public Works and Government Services, Environment Canada and Fisheries and Oceans Canada, as an Expert Support Department.

In that role, Health Canada is required to provide detailed guidance for the assessment of human health risks posed by federal contaminated sites in Canada. This research is designed to address the toxicity and genotoxicity of PAH mixtures found at contaminated sites.

The following is an outline of the scope of work to be conducted:
• Characterize PAH bioaccessibility using a juvenile swine model.
• Characterize PAH bioaccessibility using the Simulated Human Intestinal Microbial Ecosystem (SHIME).
• Calibrate previously published in vitro digestion PAH bioaccessibility model using juvenile swine and SHIME results.
• Identify critical soil parameters that modify PAH release during digestion.
• Compare mutagenic bioassays between soil and swine digestive fluids.
• Identify relevance of GIT track segments for PAH in vitro digestors.

Tasks, activities, deliverables and milestones are as follows:

Fiscal Year 2008/2009 1st Quarter (January 2009 to March 30, 2009): Conduct preliminary experiments using swine models. Assess QA/QC parameters of PAH analysis in swine digestive fluids and urinary biomarkers. Determine between-pig variability of PAH release and biomarkers which will allow for running one pig/one soil sample experiments. Samples will be preserved for in vitro bioassays of mutagenesis.

Identify and recruit suitable M.Sc. candidate, have preliminary meeting with White, Wickstrom and Siciliano to identify workflow issues and juvenile swine test design, characterize PAH levels in already collected brownfield soils.

Deliverable March 30, 2009: memo to Health Canada with preliminary results
Prepare a memo for submission to Health Canada that outlines the detailed protocol, along with supporting technical information. This memo may include, but is not necessarily limited to a review and critique of the scientific literature used in preparation of the protocol. The memo should also include preliminary results of experiments conducted to date.

Fiscal Year 2009/2010 1st and 2nd Quarter (April 2009 to September 2009): Conduct in vivo juvenile swine experiments for up to 27 different brownfield soils in order to fully characterize PAH bioaccessibility in animal model as a function of soil characteristics.
Samples will be preserved for in vitro bioassays.

Deliverable December 30, 2009: memo to Health Canada with preliminary results

Milestone #1 (October 15th 2009)
Submit manuscript to Health Canada on “Development and validation of a model describing polyaromatic hydrocarbon release from soil during incidental ingestion by humans and wildlife.”

Fiscal Year 2009/2010 3rd Quarter (October 2009 to December 2009): Run genotoxicity in vitro bioassays with Health Canada. Run juvenile swine time course experiment determining PAH and metal pollutant uptake patterns in this model. This will identify which GIT track sections are required in in vitro digestors.

Milestone #2 (February 15th, 2009)
Submit manuscript on “Mutagenic and genotoxic risk from incidental ingestion of contaminated brownfield soils”

Fiscal Year 2009/2010 4th Quarter (December 2009 to March 2010): Prepare final report to Health
Milestone #3 (March 15th 2010)
Submit final report to Health Canada.


5. Minimum requirements

Any interested supplier must demonstrate by way of a Statement of Capabilities that it meets the following minimum requirements:

a) Experience with in vitro bioaccessibility assays using the SHIME method
b) Experience conducting in vivo tests using a juvenile swine model.

6. Reason for non-competitive award

Health Canada intends to award this contract based on a sole source proposal brought to our attention by the proposed contractor. Health Canada is not aware of any other contractors who have the capability to conduct both in vitro bioaccessibility testing using the SHIME method and in vivo testing with swine.

7. Applicable trade agreements and justification for limited tendering or the Procurement Strategy for Aboriginal Business

The proposed procurement is subject to the following trade agreements: World Trade Organization - Agreement on Government Procurement (WTO-AGP), the North American Free Trade Agreement (NAFTA) and the Agreement on Internal Trade (AIT).

AIT - Under AIT, Health Canada invokes article 506 12(b)..." where there is absence of competition for technical reasons and the goods or services can be supplied by a particular supplier and no alternative or substitute exists"

NAFTA - Article 1016 (b) ..."“where for works of art or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists”

WTO - AGP - World Trade Organization Agreement (WTO) Article 15 1(b)...." when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists."


8. Ownership of Intellectual Property

Ownership of intellectual property shall rest with the Contractor.

The primary function of the University is to add to the general knowledge of society and increase its use for scholarship.

• the University’s faculty performing the Services under research contracts must have the right to submit for publication and publish in academic journals the results of the research in connection with the Services. A provision in the contract can stipulate that such publication is subject to a review and comment by Health Canada within a specified period of time.

• The University shall own and maintain registration authority over the copyrights to any thesis, journal article, conference paper, or other written report incorporating the results of the Research.

• the graduate Student must have the right to publish the results of the project in order to fulfil Thesis requirements.

9. Period of the proposed contract

The contract period shall be from date of contract award until March 31, 2010.

10. Estimated value of the proposed contract

The total estimated value of the proposed contract should not exceed $260,000, including travel and living expenses (if applicable), and all applicable taxes.

11. Closing date and time

The closing date and time for accepting Statements of Capabilities is 02 December 2008 at 2:00 p.m.EST.
