Request for Proposals for The Provision of Consulting Services for the Completion of Additional Hydrogeological Investigation Work and Operation and Maintenance of the Groundwater Remediation Pump and Treat System in Langton, Ontario

A Proponent who has not obtained this Tender / RFP through MERX will have its proposal disqualified unless a third party has requested this Tender / RFP from MERX on that Proponent's behalf and that Proponent has identified the third party on the Label of its proposal. If a Proponent who has obtained this Tender / RFP from a third party fails to identify that third party in this manner, that Proponent's Tender / Proposal will be disqualified.

Proponents who intend to respond to this procurement opportunity are requested not to cancel the receipt of addenda or amendments, since they must obtain through MERX all of the information documents that are issued through MERX.

In the event that a Proponent chooses to cancel the receipt of addenda or amendments their subsequent bid / proposal submission may be rejected.

PART 1 – INTRODUCTION
Invitation to Proponents

This Request for Proposals ("RFP") is an invitation to prospective proponents to submit proposals for the Provision of Consulting Services for the Completion of Additional Hydrogeological Investigation Work and Operation and Maintenance of the Groundwater Remediation Pump and Treat System in Langton, Ontario as further described in Part 2 - The Deliverables (the “Deliverables"). This RFP is issued by Her Majesty the Queen in right of Ontario as represented by the Minister of the Environment (the “Ministry" or “MOE”).

Type of Contract For Deliverables

The selected proponent will be required to enter into an agreement with the Ministry for the provision of the Deliverables in the form attached as Appendix A to this RFP. It is the Ministry’s intention to enter into the Form of Agreement attached as Appendix A to this RFP with only one (1) legal entity. The term of the agreement is to be for a period of nine (9) months with an option in favour of the Ministry to extend the agreement on the same terms and conditions for an additional term of up to nine (9) months. It is anticipated that the agreement will be executed on or around December 29, 2008.

A proponent who submits conditions, options, variations or contingent statements to the terms set out in the Form of Agreement, either as part of its proposal or after receiving notice of selection, may be disqualified.

Proponents are required to accept that terms and conditions which may be in place in other contracts with the Government of Ontario are not applicable or relevant to this RFP.

No Guarantee of Volume of Work or Exclusivity of Contract

The Ministry makes no guarantee of the value or volume of work to be assigned to the successful proponent. The Agreement executed with the successful proponent will not be an exclusive contract for the provision of the described Deliverables. The Ministry may contract with others for the same or similar Deliverables to those described in this RFP or may obtain the same or similar Deliverables internally.
Agreement on Internal Trade
Proponents should note that procurements falling within the scope of Chapter 5 of the Agreement on Internal Trade are subject to that chapter but that the rights and obligations of the parties shall be governed by the specific terms of each particular tender call. Insurance Requirements

Proponents are directed to the insurance requirements of this RFP set out in Article 7 of the Form of Agreement attached to this RFP at Appendix A. The Rates are to be inclusive of all insurance costs as set out in the definition of “Rates” in Section 3.2.2 of this RFP and in the Form of Agreement. If selected, the successful proponent(s) must provide proof of insurance coverage in the form of a valid certificate(s) of insurance (and, if applicable, a WISA certificate) on or before the execution of the Agreement by the Ministry.

Security Screening

Upon notification from the Ministry, the successful proponent shall require any director, officer, employee, agent, contractor or sub-contractor engaged in the delivery of goods or performance of services to undergo security clearance checks in accordance with the Ontario government's policy.

Upon notification from the Ministry, the successful proponent shall be required to provide the necessary information for each individual requiring security clearance by the Emergency Management and Security Branch of the Ministry of Government Services. If applicable, clearance checks must be completed before the successful proponent and the Ministry enter into the Agreement or may be completed during the Term of the Agreement.

Reference is made to Appendix I – Security Screening Process Background Information for further information including samples of the forms that will be required when security clearance checks are required.


Occupational Health and Safety Act Requirements

Proponents should note that the RFP contains provisions regarding health and safety requirements for proponents supplying services to the Ministry. Proponents are reminded to read the entire RFP carefully to ensure that they are aware of and comply with all of the requirements of the RFP. It is a Proponent’s responsibility to ensure that all information required by the RFP is provided and all provisions are complied with.

Compliance with Laws

The successful proponent will be responsible for obtaining and complying with any and all permits, licenses, approvals, registrations, consents, agreements or other authorizations from any federal, provincial or municipal government or agency, including the Ministry or any legal person, necessary to undertake the project. The Ministry is under no obligation to issue permits, licenses or approvals to the successful proponent and Ministry Directors retain their authority to refuse issuing permits, licenses and approvals for which the Directors have the legal authority if it is reasonable to do so, based on the information provided by the successful proponent in its application(s).

Site Visit and Proponent’s Meeting

For the benefit of proponents a visit to the affected area in Langton, Ontario will be held by the Ministry on Friday, November 21, 2008. The purpose of the site visit is to allow proponents to see the affected area and the works currently installed.

Interested proponents are to meet the Ministry at 25 Queen Street, Langton, Ontario at 11:00 a.m. on Friday, November 21 2008. Proponents will not be permitted to ask questions during the site visit. Instead, proponents are asked to make note of any questions they may have resulting from the site visit and submit them in writing to the Ministry Contact in accordance with the provisions of section 4.2.1. of this RFP.

Definitions

Unless otherwise specified in this RFP, capitalized words and phrases have the meaning set out in the Form of Agreement attached as Appendix A to this RFP.

“BTEX” means benzene, toluene, ethyl benzene, xylenes;

“Conflict of Interest” has the same meaning as defined in the RFP Appendix A – Form of Agreement;

“DIPE” means di-isopropyl ether;

“EPA” means the Ontario Environmental Protection Act, R.S.O. 1990, c. E-19;

PART 2 - THE DELIVERABLES

Background

In 1988, benzene contaminated groundwater was identified in the Village of Langton. The contamination originated from the underground storage tanks of a former service station located at 25 Queen Street, Langton, Ontario. The benzene contamination has migrated under Queen Street as free product and a dissolved phase plume has been determined to be moving deeper along the groundwater flow path. The project area extends from the gas station at 25 Queen Street, east towards the North Walsingham Public School, including the residences on the south side of Albert Street and 28 and 30 Queen Street, Langton, Ontario including a small portion of Highway 59.

The contaminated groundwater affected shallow potable water well supplies (sand points) at a number of residences around the intersection of Albert and George Streets and the MOE installed cisterns for the impacted residents. In 1996 Di-isopropyl Ether (DIPE) was detected in a local school well and in 1998 DIPE was detected in one residential well. In 1999 the Ministry retained a consultant to identify the source of contamination, delineate the extent and provide the affected properties with potable groundwater supplies. The consultant’s report identified a plume containing BTEX and DIPE originating at 25 Queen Street and travelling southwest under the impacted residential properties and school property. Free product was identified in a monitoring well adjacent to 25 Queen Street. In 2002 a consultant retained by a third party conducted a subsurface investigation in an attempt to delineate the extent of contamination in the vicinity of 28 Queen Street In 2003 a consultant investigated the contamination at 25 Queen Street, Langton, Ontario.

In 2004 the Ministry retained a consultant to provide potable water supplies to the 6 residences affected by the contamination, address vapour intrusion in one residence, delineate the contamination at the source area and install and operate a pump and treat system. The Ministry is in the process of completing the water supply installations to residents. The issue of vapour intrusion/indoor air quality at one residence is the object of a different project. Delineation of the petroleum hydrocarbon contamination and an attempt at sealing the residence affected by vapour intrusion were finalised in 2005 and the pump and treat system has been commissioned in April 2006.

The pump and treat system is designed to treat groundwater contaminated with Liquid Petroleum Hydrocarbons (LPH). The system is located in a closed shed in the backyard of the residence located at 28 Queen Street, Langton, Ontario. There are two (2) Certificates of Approval that relate to the operation of the pump and treat system; a Certificate of Approval (Air) and a Certificate of Approval (Industrial Sewage Works). The pump and treat system has been modified and optimized since its commissioning to allow for continuous operation. The Ministry had a six (6) months operation and maintenance contract with a contractor which expired at the end of July 2008. Regular Operation and Maintenance of the system is part of this RFP.

In the system’s treatment process, LPH contaminated groundwater is treated by being pumped from a sump into an oil/water separator, the overflow passing through an air stripper, a system of bag filters and activated carbon to further remove volatile organic compounds (“VOCs”), and another filter media to remove lead. The groundwater is treated to acceptable levels, as required by the system’s Certificate of Approval, and is discharged into the storm sewer system.

The Ministry has been conducting an abatement program in Langton for a number of years. Proponents may review all the studies, maps and monitoring results that are available from previous work conducted in the area.

Project Objectives

Proponents will be required to undertake five (5) milestones composed of various tasks. These five milestones are:

• Develop a preliminary conceptual site model of the extent, fate and transport of contamination originating from 25 Queen Street to the North Walsingham Public School;

• Undertake sampling and subsurface investigations to obtain additional information for the completion of the conceptual site model;

• Finalize the conceptual site model;

• Develop a remedial action plan to address the petroleum hydrocarbon contamination impacted soils and ground water from 25 Queen Street to the North Walsingham Public School; and

• Operation and Maintenance of the Groundwater Remediation Pump & Treat System, located in the shed at 28 Queen Street.

Under the direction of the Ministry’s Project Coordinator, the successful proponent will liaise with staff of Norfolk County, the local Health Unit, the Ministry’s West Central Region Technical Support Section, and any other party considered to be relevant to the project.
