SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The Contracting
Authority has identified the need for a major programme of inspection,
risk assessment, overhaul and refurbishment to be undertaken to the water
supplies and storage tanks to approximately 12 287 dwellings (of which 63
% are flats) in Brighton and Hove. Works to individual dwellings are
likely to be restricted to a sample survey and risk assessment. The
contract will concentrate on maintaining clean and safe water services to
properties with communal water supply services.
Brighton & Hove City Council is therefore seeking expressions of interest
from innovative and suitably resourced, qualified and experienced
contractors to carry out a programme of inspections and risk assessment,
cleaning and maintenance, capital replacement and to take responsibility
for responsive repairs to water supplies and water storage tanks.
The successful contractor will be required to enter into the ACA Standard
Form of Contract for Term Partnering (TPC2005) with a term of 10 years
with break clauses at years, 3, 6 and 9.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: To provide inspection, testing and
maintenance of water services to comply with Health and Safety Executives
Approved Code of Practice and Guidance. Document L8. This includes survey,
asset report and risk assessment of approximately 200 sites, providing
cleaning, maintenance, water sampling and testing, corrosion inhibitors
and biocides as required and tabulating relevant data, repairs and capital
replacements to communal water tanks at approximately 150 sites. The
contract will include the provision of out-of-hours and emergency
responsive repairs. It is intended that the contracts be capable of being
used by all group members and all social landlords with stock in the areas
set out in section II.1.2 of this Notice.
Estimated value excluding VAT:
Range: between 1 500 000 and 2 500 000 GBP.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 120 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Details of the deposits and
bonds required by the Contracting Authority will be set out in the Tender

reference to the relevant provisions regulating them: Details of the main
terms and conditions of financing and payment will be set out in the
contract documents.

contract is subject: Yes.
Under the contracts, the contractors and service providers and any supply
chain will be required to actively participate in the achievement of
social and/or environmental policy objectives relating to training and
supply chain initiatives. Accordingly, the contract performance conditions
may relate in particular to social and environmental conditions.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: All
applicants will be asked to confirm in a pre-qualification questionnaire
that none of the conditions set down in Article 45 of EC Directive
2004/18/EC apply to their organisation or expression of interest.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: Applicants will be
required to complete a pre-qualification questionnaire consistent with the
provisions of Directive 2004/18/EC. The questionnaire is available from
the correspondence address in I above and must be returned to that address
by the date stipulated in IV 3.4.
Minimum level(s) of standards possibly required: Minimum turnover must be
greater than four times the estimated total annual contract value.

complete a pre-qualification questionnaire consistent with the provisions
of Directive 2004/18/EC. The questionnaire is available from the

the date stipulated in IV3.4.
