SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Nottingham Express Transit (NET): Land and Property Valuation and
Compilation Services.

II.1.5) Short description of the contract or purchase(s): Nottingham
Express Transit (NET) – Project Background: On 31.3.2000, the Contracting
Authorities awarded a concession agreement to Arrow Light Rail Limited for
the design, construction, financing, operation and maintenance of
Nottingham Express Transit Line One ("NET Line One"), which has been in
successful operation since March 2004. NET is a light rapid transit system
serving Greater Nottingham. NET Line One is 14.5 kms in length and
operates between Hucknall (to the north of the City boundary) and
Nottingham City Centre (with a spur to Phoenix Park, close to junction 26
of the M1 Motorway). NET Line One opened in March 2004 and carries
approximately 10 million passengers a year. The Contracting Authorities
wish to extend NET Line One with two further lines, collectively known as
NET Phase Two. NET Phase Two is a 17.5 km length proposed extension that
would connect with NET Line One and serve the south-west and western part
of Greater Nottingham. The Chilwell/Beeston extension would serve some key
destinations, including the Queens Medical Centre, University of
Nottingham, and Beeston Town Centre. The Clifton/Wilford extension would
serve residential areas including the Meadows, Wilford/Compton Acres and
Clifton. Both routes would terminate at park and ride sites which would
serve junctions 24 and 25 of the M1 Motorway. An application for a
Transport and Works Act Order (TWAO) for NET Phase Two was submitted to
the Secretary of State for Transport in April 2007 and a decision is
expected in February/March 2009. Therefore, subject to further approvals
being granted by the Department for Transport, the Contracting Authorities
intend to terminate the existing NET Line One concession agreement and to
award a new single PFI concession agreement covering both NET Line One and
Phase Two ("New Concession Agreement"). Subject to the necessary approvals
being in place construction works are due to commence in early 2011 with
the system opening in early 2014. The Contracting Authorities now wish to
procure property services in connection with NET Line One and NET Phase
Two. Any person/ organisation who would like to express an interest in
provision of property services should request a copy of the
pre-qualification questionnaire from Sophia Spanton at the address
specified in Annex A.1. The deadline for receipt of pre-qualification
responses is 12 noon Greenwich Mean Time (GMT) on the 5.1.2009. Services
Summary: The successful candidate will be the Contracting Authorities'
main adviser in relation to all land and compulsory purchase issues
relating to the NET system. They will be responsible for the
identification of the landowner (and other interests) and all associated
tasks leading to the acquisition, whether through voluntary transfer or
compulsory acquisition, of land and interests in land required on behalf
of the Contracting Authorities and deal with Part 1 Claims” under the Land
Compensation Act 1973.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The services required may include:
1. Updating details of all land ownership and interests along the two new
extension lines comprising NET Phase Two as defined by the TWAO
Plans/documentation (Book of Reference);
2. Providing an updated ownership schedule listing properties, interests
and parcels shown on the TWAO plans/documentation;
3. Preparation/modification of plans showing land ownership/interest
details;
4. Preparation and provision of notices, including without limitation
notices to treat and notices of entry;
5. Service of notices;
6. Preparation and development of land acquisition strategy;
7. Property purchase, valuations and negotiations;
8. Compulsory purchase advice and negotiation;
9. Compensation advice and negotiation;
10. Estimating letting value of land and properties;
11. Interpretation and implementation of the NET Phase Two TWAO in
relation to property interests;
12. Investigation and determination of title and other property
ownership/interest rights;
13. Operation of procedures for the NET system to acquire land and rights
in land both permanent and temporary and take into account any contractual
agreements which the Contracting Authorities have entered into with
affected land owners/occupiers;
14. Providing advice in connection with negotiations with objectors
including advice on agreements for the voluntary transfer of land and
interests in land;
15. Advising on, preparation and arranging publication, exhibition and
service of press and site notices and notices to owners, lessees and
occupiers and others entitled to notices in connection with the
acquisition of land and interests in land pursuant to compulsory
acquisition powers
16. Dealing with all issues arising from the implementation and
enforcement of Compulsory Purchase powers for the NET System, including
providing evidence at Inquiries, Courts and the Lands Tribunal;
17. Liaison with the Contracting Authorities' in house property teams
regarding acquisition strategies, valuation and property management
issues;
18. Provision of all other property advice required in connection with the
acquisition of land and interests in land necessary for NET Line One and
NET Phase Two;
19. Cost control and reporting service. See also section II.1) 5 above.
II.2.2) Options: Yes.
Description of these options: The Contracting Authorities may include the
option to extend the initial contract term and/or include additional
services within the scope. Furthermore, a public services contract for new
services would be a repetition of the services provided under the Land and
Property Valuation and Compilation Services Contract may be awarded by the
Contracting Authorities without prior publication of a contract notice
using the negotiated procedure in accordance with Regulation 14(1)(d)(ii)
of the Public Contracts Regulations 2006.

Contracting Authorities intend to invite a minimum of 5 candidates to

Section II.3 - Duration of the Contract - the Contracting Authorities
envisage that the Land and Property Valuation and Compilation Services
Contract will be for a term up to and including the opening of Phase 2 to
passenger operations and beyond to deal with any claims during the early
stages of operation.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Contracting Authorities will incorporate a minimum 10
calendar day standstill period at the point information on the award of
contract is communicated to candidates. This period allows unsuccessful
candidates to seek further debriefing from the Contracting Authorities
before the contract is entered into. Applicants have two working days from
the notification of the award decision to request additional debriefing
and that information has to be provided a minimum of three working days
before the expiry of the standstill period. Such additional information
should be requested from the addressee in Annex A1. If an appeal regarding
the award of the contract has not been successfully resolved, the Public
Contracts Regulations 2006 (SI 226 No 5) provide for aggrieved parties who
have been harmed or at the risk of harm by a breach of the rules to take
action in the High Court (England, Wales and Northern Ireland). Any such
action must be brought promptly (generally within three months). Where a
contract has not been entered into, the Court may order the setting aside
of the award decision or order the Contracting Authorities to amend any
document and may award damages. The purpose of the standstill period
referred to above is to allow parties to apply to the Courts to set aside
the award decision before the contract is entered into.
