ADVANCE CONTRACT AWARD NOTICE

Requirement:

For the provision of Aluminum (Al) Powder Grade H-2, H-10 and
H-30 used in blast and explosion testing for the Department of
National Defence, Defence Research and Development of Canada
(DRDC), Canadian Forces Base Suffield, Ralston, Alberta.

Sole Source Justification:

The proposed sole source purchase is linked to a number of
previous procurements for obtaining the same aluminum powder
over the past six years for blast and explosion testing. The
same powder will be used for trials to be conducted in 2008 and
2009 as required under a US-CA collaboration program. These
large scale trials are based on the data obtained over the past
6 years where we found that powder morphology and size are
parameters to which the results are extremely sensitive.
Therefore it has been requested that the upcoming large scale
experiments use the exact same powder in accordance with the
collaborative program requirements. The scientific strategy
behind the planned large scale trials is based on the results of
a scaling investigation that has cost more than 3 million
dollars over a period of six years. The efforts involved in
re-characterizing a different or equivalent product will cost
the same amount of resource and time. Furthermore, this
duplicate work does not guarantee the same results required for
the planned large scale trials.

This procurement is to purchase a commercial product (Al powder)
whose trade mark is owned by the U.S. company "Valimet Inc.".

Usage of the same Al powder satisfies the requirement of a US-CA
collaboration program in which trials must be conducted in 2008
and 2009 using the exact same Al powder as required in this
purchase. Equivalent products are not acceptable.

The item required is an export controlled product and requires a
U.S. State Department certificated license. DRDC Suffield
currently holds such a license for purchasing Valimet Al powder.

Government Contracts Regulations (GCR) Exception

5.002 (D) (2002-12-13) - Only one supplier person or firm is
capable of performing the contract.

AIT Limited Tendering

In accordance with AIT Article 506, Section 12 (B), where only
one supplier is able to meet the requirements of a procurement,
an entity may use procurement procedures that are different from
those described in paragraphs 1 through 10 in the following
circumstances:

(b) where there is an absence of competition for technical
reasons and the goods or services can be supplied only by a
particular supplier and no alternative or substitute exists

In accordance with NAFTA Article 1016.2

(b) where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists.

(d) for additional deliveries by the original supplier that are
intended either as replacement parts or continuing services for
existing supplies, services or installations, or as the
extension of existing supplies, services or installations, where
a change of supplier would compel the entity to procure
equipment or services not meeting requirements of
interchangeability with already existing equipment or services,
including software to the extent that the initial procurement of
the software was covered; (CAP Code 74)

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
